DATAWING RIGHTS AND RESPONSIBILITIES
This document describes your rights and responsibilities when using Datawing.
These rights and responsibilities described in this document apply to all users regardless of their ability to form a legal contract with Datawing. Datawing reserves the right to suspend or restrict the access of any member who does not adhere to them.
Ownership
1. You own all of the content and information you post on Datawing, and you can control how it is shared through your privacy settings or customer privileges. We will distribute the content in accordance with your privacy settings or customer privileges (if you are an organisation) and we promise to observe those settings.
2. When privacy settings are changed there may be some time-lag between you changing settings and all of our servers receiving the up to date settings for controlling access to your content.
3. When you post content on Datawing you must be the copyright owner or have the copyright owner’s permission to post the content.
4. If you make any content public then you are permitting us to distribute that content freely to anyone in the world until such time as you delete the content or your account.
5. If you have made content available to any given person then you are permitting them to use the content for their own personal use. If you are an organisation providing access to specific contents through customer privileges then you may supplement this with an additional licence agreement.
6. When content is deleted it may persist on the system as the action propagates through our servers and it may persist in backup copies for a reasonable period of time.
7. When you permit an application to access your content we require applications to respect your privacy.
Your Account and Profile
1. You will not create more than one account on Datawing.
2. You will not provide false personal information on Datawing.
3. If you are a personal user then you may use an alias for your account name provided it is a name you are known by. In any case your account must specify your legal name either in the main account name fields or in the “other names” section of your account. If we believe that your alias is inappropriate, misleading or an attempt to impersonate somebody then we reserve the right to replace the alias with your legal name.
4. You may specify a username for your account. We reserve the right to remove your user name or assign another if we believe that it is inappropriate, misleading or an attempt to impersonate somebody. You do not own your user name and you may not transfer or assign your username to another person as part of any transaction.
5. If you are under 16 years of age you will not use Datawing without appointing a chaperone. Your chaperone will have access to your account and profile. They may view any content you post. They may amend your basic account details, including your name, contact details and date of birth. They may ask for your account to be deleted.
6. If your account is disabled or closed by us then you will not create another one without our permission.
7. You must not create an account if you are a convicted sex offender
8. You must not divulge your password, or in the case of applications; your private key information, to anybody else.
9. You may not assign or transfer your account to anybody else without our prior written consent.
Your Conduct
You must not:
1. Post content that is hateful, discriminatory or threatening, or that incites or depicts violence to humans or animals
2. Post content that is pornographic or contains nudity
3. Post content that is in any way illegal
4. Post content that is in breach of copyright, trademark, confidence, privacy or any other right
5. Post content or send messages consisting of or containing software viruses, worms or malicious code or any unauthorised commercial communications (“spam”).
6. Engage in any form of bullying, harassment or intimidation of other users or people.
7. Solicit login information or access an account belonging to someone else
8. Use Datawing for fraudulent purposes, or in connection with a criminal offence or other unlawful activity
9. Systematically extract and/or re-utilise parts of the contents of our website, and in particular utilise any data mining, robots, or similar data gathering and extraction tools to extract any substantial parts of the website.
10. Create and/or publish your own database that features any substantial part of the content of Datawing.
11. Do anything that could disable, overburden, or impair the proper working of Datawing, such as a denial of service attack.
Your Responsibilities
1. You may only post content that has a BBFC Rating of 18 or below (R18 material is not acceptable); If you post material rated 12 or above then you must specify the correct rating for the material so that we may correctly censor it.
2. If you collect information from users, you will obtain their consent and expressly state that it is you and not Datawing who is collecting and responsible for their information. You will post a privacy policy outlining the information you collect and how you will use it.
3. You will not post any information on Datawing that personally identifies a user or comprises of their personal information and which may infringe their right to privacy. For example, posting a person’s name and address or their phone number in a news post is not acceptable.
4. You will not use our copyrights or trademarks without our express permission.
Your Rights
1. You have the right to privacy and we therefore do our up most to ensure that your privacy settings are adhered to and that your data is stored securely.
2. If we remove content for copyright infringement reasons and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
Our Rights
1. We can remove any content or information you post on Datawing if we believe that it violates the rights and responsibilities outlined in this document or if it has been posted with an incorrect age rating.
2. If you repeatedly infringe other people's intellectual property rights, privacy or post content with an incorrect age rating, we will disable your account.
3. In all other cases we operate a zero tolerance policy and will disable your account immediately.
